Drug-Free Campus Policy

Unlawful possession, use, production, distribution or sale of alcohol or other drugs by any faculty, staff or student is prohibited on University property or as any part of University activities.

Regulations

1.   This policy is created to comply with Drug-Free School and Communities Act Amendments of 1989 (Public Law 101-226) which requires that the University show it has adopted and implemented a program to prevent the illicit use of drugs and the abuse of alcohol by faculty, staff and students, and to set forth the University's standards to provide a community setting that is safe, healthy and productive for all faculty, staff and students of Texas Southern University.

2.   In 1985, Texas amended its definition of "minor" to mean a person under the age of twenty-one (21).  Minors are prohibited from purchasing alcoholic beverages by section 106.02(a) of the Alcoholic Beverage Code. Further, section 106.03(a) makes it unlawful for a person to sell alcoholic beverages to a minor.  Section 106.06(a) prohibits anyone from purchasing alcoholic beverages for a minor.  [The only exception to 106.06(a) is for adult parents, guardians, spouses or other adults to whom the courts have given custody of the minor (106.06(b)].

3.    Any faculty, staff or student violating this policy will be subjected to the appropriate University disciplinary procedures.

4.   The use of alcoholic beverages by students of Texas Southern University and any guest is prohibited in all areas of the University and at University sponsored activities off campus. The only exception to this rule is when the serving of alcoholic beverages is approved by a university official (vice president of student services or a higher authority) in writing. The host of such events will assume the responsibility of assuring that persons of legal age are only served (social host liability).

The use, possession, acquisition, sales, manufacturing, and distribution of any illicit drug on the campus of Texas Southern University and at any university activity off campus is prohibited. Marijuana, cocaine, heroin, crack, amphetamines, LSD, PCP, sedatives/hypnotics, and inhalants are considered illicit (please note that this is only a partial listing of illicit drugs).
