Faculty Expert Witness Reporting
Texas Education Code §61.0815 requires the University to report annually to the Texas Higher Education Coordinating Board whether any faculty members have served as expert witnesses in lawsuits against the state during the past year. This law was passed during the 76th legislative session in 1999 following the ruling in Robert Hoover, et al. v. Dan Morales, et al., where the Fifth Circuit Court of Appeals held that a rider in the 1997 Appropriations Act prohibiting state employees from serving as expert witnesses in lawsuits against the State of Texas was unconstitutional. The new law requires state employees who serve as consulting or testifying witnesses to report certain information to their employer.
